Terms & Conditions

By subscribing to “The Randstad Ride", I agree to the following terms and conditions in this Waiver and Release.

The Randstad Ride is an initiative promoted by Randstad Interim Inc and Randstad North America as "The Randstad Ride".

The Randstad Ride (“the Event”) has adopted international best practice standards and risk management principles and guidelines.  The Event also adheres to local health and safety acts, regulations and codes of practice to reduce any risks associated with the Event to as low as reasonably practicable, ensuring your safety and enjoyment. 

I confirm my participation in the Event is voluntary and agree my participation in the Event is subject to the sole discretion of the organizers of the Event and may be limited or terminated by the organizers of the Event, with or without cause. I understand participating in the Event, which may include using public streets may be hazardous and may result in serious harm, personal injury or death.  I am aware of, and I expressly assume, all risks associated with participating in the Event, including, without limitation, falls, contact or accidents with other participants, persons, bicycles, vehicles or objects, changing and dangerous road, traffic and weather conditions, risks associated with participating in a group ride, travelling through mountainous terrain, travelling at high rates of speed, equipment failure including burst tires and brake malfunction, conditions relating to strenuous physical activity including heat exhaustion, severe dehydration, paralysis, as well as heart attack and stroke.  In addition, I expressly assume all risks associated with participating in the Event regardless of whether such risks are covered by my personal health insurance, employer-provided health insurance, or other types of insurance.  

I understand and agree that Randstad North America, Inc., Randstad Interim, Inc., Randstad Canada Charitable Foundation, any Event participants and volunteers, and each of their respective affiliates, directors, officers, employees, agents and representatives (collectively, the “Released Persons”) will not be liable for any harm, personal injury or death in any way arising out of the Event.  I further understand and agree that I will not be able to claim any damages or other compensation from the Released Persons which means I will be personally liable for, and have to bear all costs and expenses associated with, any harm or injury in any way arising out of the Event, however serious, including death.  In addition, I expressly discharge and forever release the Released Persons from all liabilities, claims, demands, losses or damages (“Claims”) for or by reason of, or in any way arising out of the Event including, but not limited to, Claims for damages for death, personal injury or property damage, even where such Claims arise from a Released Person’s negligence or carelessness. 

In waiving such Claims I understand I am waiving any Claims against the Released Persons where the Released Persons failed to take measures available and/or necessary for safety in the circumstances, including, without limitation, matters relating to the failure to provide any or adequate assistance or first aid, and the failure to have adequate resources available or to respond to emergencies.  I further agree not to make any Claims or take any proceedings (including, without limitation, any cross-claim, counterclaim, third party action or application) against any other person who might claim contribution or indemnity against a Released Person with respect to matters covered by this Waiver and Release.

I confirm that I am physically capable of, have sufficiently trained for, and have the knowledge, capability and experience necessary to participate in, the Event.  

I also agree to abide by all rules and regulations established by the Event organizers, staff and support personnel as well as all traffic laws and local vehicle codes if running, walking or riding on public streets.  I agree to refrain from consuming illegal drugs or alcohol that may impair my ability to participate safely in the Event.  Failure to abide by any applicable policies, procedures, rules, laws, or regulations may result in my expulsion from Event.

I will use appropriate and proper safety equipment during the Event that is mechanically fit for its intended purpose and meets applicable government or industry standards.  I agree to wear a helmet at all times when riding as part of the Event, obey all traffic signs, signals, rules of the road and instructions from Event organizers and law enforcement personnel.  If I am aware of, or under treatment for, any physical infirmity, disorder, ailment, or illness, my medical care provider has been apprised of, and has approved of, my participation in the Event.  I acknowledge I am solely responsible for my personal health and safety, and any personal property brought to the Event. 

I give permission and consent to the Released Persons for the free use of my name, photograph, voice and likeness (collectively, “Images”), in any broadcast, telecast, website, social media, advertising promotion, or other account of the Event or marketing or promotion for future or similar events, and in any other form of media reproduction whatsoever in perpetuity, and waive any rights of privacy I may have in that regard, and I understand and consent that I will periodically be receiving communications related to my participation in the Event.  I hereby release and discharge the Released Persons from any and all Claims in connection with the use of my Images and the reproduction thereof as aforesaid. I understand and agree that Released Persons will be the exclusive owner of all rights, including, but not limited to, all copyrights, in and to the Images in whole or part, throughout the universe, in perpetuity, in any medium now known or hereafter developed, and to license others to so use them in any manner a Released Persons may determine in its sole discretion, without any obligation to me.

I have carefully read this Waiver and Release and fully understand its contents.  I have had the opportunity to obtain independent legal advice and I am aware this Waiver and Release constitutes a release of liability and that I have given up substantial rights, including my right to sue, and that I am personally assuming all liability and agreeing to personally pay for any and all costs and expenses in any way arising out of the Event, however serious, including death. 

This Waiver and Release will be binding upon each of my heirs, executors and administrators, and will ensure to the benefit of each of the Released Persons and their respective heirs, executors, administrators, successors and assigns. This Waiver and Release shall be governed by and interpreted in accordance with the laws of the Province of Ontario.  Any action or proceeding arising out of or relating to the Event or this Waiver and Release must be brought in the courts of the Province of Ontario.
